## 1. Introduction
This agreement applies as between you, the User of this Website and Wide Awake Parenting, the owner of this Website. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.
No part of this Website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and Our acceptance of that offer is deemed to occur upon Our sending a confirmation email to you indicating that your order has been accepted.
## 2. Definitions
In this Agreement the following terms shall have the following meanings:
"Account": means collectively the personal information, Payment Information and credentials used by Users to access Courses and/or any communication features on the Website;
"Content": means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;
"Course" / "Courses": means the structured educational programs offered through the Website, including but not limited to The AWAKE Method™, The Practice, Constellation Course, and age-specific developmental courses;
"Educational Content": means all course materials, videos, PDFs, worksheets, guides, and resources provided for informational and educational purposes only, not as psychological services, therapy, or medical advice;
"Facilities": means collectively any online facilities, tools, services or information that Wide Awake Parenting makes available through the Website either now or in the future;
"Payment Information": means any details required for the purchase of Courses from this Website, including credit/debit card numbers and payment processor information;
"Services": means the educational services available through this Website, specifically access to the Wide Awake Parenting online learning platform and Courses;
"Student": means a User who has purchased or been granted access to one or more Courses;
"System": means any online communications infrastructure that Wide Awake Parenting makes available through the Website;

## 3. Eligibility and Business Customers
3.1 You must be at least 18 years of age to purchase Courses or use this Website.
3.2 Courses are designed for adult learners (parents, caregivers, and professionals).
3.3 These Terms and Conditions also apply to customers procuring Services in the course of business.
3.4 We accept Students from all countries. However, Course content is based on U.S. research and practices. You are responsible for determining applicability to your local context and regulations.

4.1 All Content included on the Website, unless uploaded by Users, is the property of Wide Awake Parenting, Dr. Kirsten Kuzirian, our affiliates or other relevant third parties. 5.1 Course materials, including videos, worksheets, PDFs, and all Educational Content are the exclusive property of Wide Awake Parenting and are licensed to Students for personal use only. Students may not share, distribute, or reproduce Course materials.
5.2 You may not reproduce, copy, distribute, store or in any other fashion re-use such material unless given express written permission by Wide Awake Parenting.
## 6. Fair Use
Material from the Website may be re-used without written permission where fair use provisions of U.S. Copyright Law apply, including for personal study or criticism and review.

9.1.7 Not impersonate others, particularly Wide Awake Parenting representatives;
9.1.8 Not use Our System for spam or mass communication;
9.1.9 Not provide medical, psychological, or therapeutic advice to other Users.
9.2 Wide Awake Parenting reserves the right to monitor communications made to Us.
9.3 We may retain copies of communications for quality assurance and course improvement.
9.4 Any feedback, suggestions, or testimonials you send may be used by Wide Awake Parenting for marketing or educational purposes, though personally identifying information will not be shared without explicit consent.
9.5 Student-to-student communication features are not available. All communications should be directed to legal@wideawakeparenting.com.
## 10. Account Security
10.1 Account creation may be required for Course access.
10.2 Do not share your Account details. We accept no liability for losses from shared Account details. Do not save Account details on shared computers.
10.3 If you believe your Account has been compromised, contact Us immediately at legal@wideawakeparenting.com. You remain responsible for all activity under your Account until you notify Us.
10.4 Usernames must comply with Clause 9 standards.
10.5 Course access is licensed to individual Students only. Sharing Account access violates these Terms and may result in termination without refund.
## 11. Account Termination
11.1 Either party may terminate your Account. If We terminate, you will be notified by email with explanation. We reserve the right to terminate without giving reasons.
11.2 Upon termination by Us, current Course access will end and no refunds will be provided for partially completed Courses.
## 12. Service Descriptions
12.1 While We ensure Course descriptions are accurate, exact implementation may vary based on updates and improvements. This refers only to variations in delivery method, not different Courses altogether.
12.2 You may be required to select specific Courses or bundles.
12.3 We cannot guarantee Course availability at all times.
12.4 Prices are correct at time of posting. We reserve the right to change prices and alter special offers.
12.5 The price valid at time of order will be honored even if prices change subsequently.
## 13. Service Provision and Payment
13.1 Course access typically begins immediately upon payment confirmation.
13.2 Payment is processed immediately upon order placement.
13.3 If We cannot accept your order, any payment will be refunded within 14 calendar days.
13.4 Payment is taken via your chosen method at time of purchase for one-time Course fees.
13.5 Course access is typically granted within 24 hours of payment. We are not liable for minor delays.
13.6 Wide Awake Parenting provides Educational Content with reasonable skill and care.
13.7 If you receive incorrect Course access, contact Us immediately for correction within 5 working days.
13.8 Technical support is provided via email at courses@wideawakeparenting.com. We strive for timely responses but do not guarantee specific response times.
## 14. Cancellation and Returns
14.1 Digital Course Refund Policy: Due to the immediate access nature of digital Courses, refunds are limited to:
- Technical issues preventing Course access (verified by Our team)
- Duplicate purchases
- Within 7 days of purchase if only Module 1 has been accessed
- No refunds once Module 2 or beyond has been accessed
14.2 To request a refund, email courses@wideawakeparenting.com with your order details and reason for request.
14.3 Educational Disclaimer: All Courses are for educational purposes only. We do not guarantee specific outcomes or results. No refunds will be provided based on subjective satisfaction or results.
## 15. Liability Disclaimer for Educational Content
15.1 Not Therapy: Course content is educational only and does not constitute psychological services, therapy, medical advice, or establish a therapeutic relationship.
15.2 Seek Professional Help: If you or your child need clinical support, please consult qualified professionals in your area.
15.3 No Guarantees: We make no guarantees about specific parenting outcomes or child behavior changes resulting from Course content.
15.4 International Students: Dr. Kuzirian is licensed as a psychologist in California, USA only. International Students acknowledge that Course content is based on U.S. research and practices and may need adaptation for local contexts.
## 16. Privacy
16.1 Personal information is collected and used in accordance with our Privacy Policy, available at wideawakeparenting.com/privacy, and in compliance with applicable U.S. data protection laws, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and with the EU General Data Protection Regulation (GDPR) and UK GDPR for users in those jurisdictions.
16.2 We may use your information to:
- Provide Course access
- Process payments
